Terms of Service

Draft - needs lawyer review. This document describes how Nomisly actually works but has not yet been reviewed by a lawyer for the operating entity and each jurisdiction.
The agreement
These Terms are between Nomisly (operated by its founder, India; legal entity details to be added) and the business that signs up ("you"). By creating an account you agree to them.
Trial, plans and billing
New accounts get a 15-day free trial with capped usage credits; no card is required. Paid plans are billed monthly in advance unless you choose annual billing. Prices are shown per region on the pricing page and exclude taxes.
Usage fees (messaging, SMS, voice minutes, AI above included amounts) are pass-through and charged from a prepaid wallet with a spend cap you control. If you connect your own WhatsApp Business Account, Meta bills you directly for WhatsApp messages.
We never charge fees on payments your customers make to you.
Cancellation
You can cancel at any time from Billing in one click. Service continues until the end of the paid period. Annual plans are never renewed without a reminder at least 14 days in advance.
When your trial or paid plan ends, your workspace moves to the free plan: the website chatbot, knowledge base and your data stay available, and WhatsApp and other outgoing messages pause until you choose a plan. You can export your data at any time; if you close your account we notify you before deletion.
Your responsibilities
You must have a lawful basis and any required consent to message your contacts, comply with channel policies (including Meta's WhatsApp Business policies and messaging limits), register SMS senders where required (for example A2P 10DLC or DLT), and follow our Acceptable Use Policy.
You are responsible for the information you give the AI assistant and for reviewing templates before submission.
AI outputs
AI-generated replies can be wrong. The Service is designed to answer from your information and hand over when unsure, but you remain responsible for customer communications. Don't use the Service to give medical, legal or financial advice.
Healthcare data
We do not currently sign HIPAA Business Associate Agreements. US covered entities must not store protected health information in the Service.
Availability and support
We aim for high availability but don't guarantee uninterrupted service on the entry plans. Support is available in-app and on WhatsApp.
Liability
To the extent permitted by law, our total liability is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect or consequential losses.
Changes and law
We may update these Terms with notice. Governing law and venue: to be specified by counsel for the operating entity.
